Introduction Thank you for choosing Jaribu, a great place to book a professional service in your home, hotel, office and etc. These terms and conditions of service together with any terms and policies referred to in them (Our Terms) constitute a legally binding agreement between you and Jaribu (“Jaribu”, “we”, “us” or “our”). Jaribu is a private limited company found by Mrs. Ni Putu Sri Cakowarini ( Founder of Bulan Jani Consultant ) it is one of success spa consultant in spa industry like Serayu Spa at The Kayon Jungle Retreat. Jaribu office is located at I Gusti Ngurah Rai street , North Badung Regency, Bali – Indonesia. USE OF OUR WEBSITE Our Terms govern your use of our website (“Our Site”) and the Services. By using Our Site, or the Services, you agree to comply with Our Terms. Please read Our Terms carefully and thoroughly. SELF SERVICE - BOOKING THROUGH OUR WEBSITE Jaribu has an online option for people seeking massage therapy and other treatment therapy for relaxation by professional’s therapist at a massage facility or at their home, office, hotel, or special event. Jaribu is not personally affiliated the massage providers listed on this website nor are we personally familiar with each one of their services. We do not support any illegal activities or practices and each provider is responsible for his or her own licensing, certifications and insurances, for whichever areas he or she provides these services, as required by law. Jaribu does not fully investigate the individuals who have listed themselves on this site nor does Jaribu evaluate the quality of their services. While Jaribu monitors the reviews of the various individuals listed on this site, the listing of such individuals does not constitute an endorsement by Jaribu, of their competence, skill, honesty or character. It is up to the client, member of the house, or group) using this website to do a full screening of the massage provider(s) on the phone before the appointment time. The client uses the services of any provider listed on this website at his/her own risk, and Jaribu will not be liable for any injury or loss suffered by the client due to the negligence or deliberate misconduct, illegal or otherwise (including criminal conduct) of individuals listed on this website. By using this service, client agrees to only contact the provider about obtaining a therapeutic massage. If a client makes an appointment request through the website, he/she understands that there may not be a suitable provider in his/her area. Client also understands that if a message is left for a provider that a provider may not return the call or email. If Client is under the age of 18, an adult must be present somewhere in the same location at all times during the massage. Any client feedback or reviews of therapists, etc. that are submitted to Jaribu by clients or potential clients via web forms or email may be used in publicity material such as website promotions, brochures, newsletters, or other publications. All financial transactions regarding massage appointments booked through the directory are between the client and the provide BOOKING PROFESSIONAL SERVICES You can make a booking through Our Site by choosing an Independent professional. You may only make a booking up to one weeks in advance. Your payment details will be requested at the time of booking and payment will be collected when you make a booking. Full payment of the Treatment Fee is due at the time of booking the Professional Service with the Independent professional through us. Full details of the prices are referred to below. Jaribu will collect 30% of the treatment price for deposit on our side and 70% treatment Fee belongs to the Independent professional who provides the Professional Service. We are appointed by Independent professionals to conclude bookings on their behalf as their commercial agent. Once your booking is accepted by us on behalf of the and the Independent professional, you will receive confirmation of your appointment from us by email. By making a booking, you are responsible for: • Full payment of the applicable Treatment Fee; • 30% deposit by bank transfer to website and 70% cash handed to provider • Ensuring the Independent professional has access to your Designated Premises which must, in all cases, represent a suitable space in which the Professional Service can be performed, with all appropriate facilities (including adequate lighting and heating); and • Ensuring the health and safety of the Independent professional whilst at your Designated Premises. APPOINTMENTS CANCELLATION CLIENTS: Jaribu has a 24 hour per provider cancellation policy. That means if the client books 2 providers, he/she needs to give 48 hours’ notice for cancellation. Failure to give this notice will result in being charged the full amount of the appointment. If the client books the appointment from 24 hours to 1 hour before the scheduled appointment, there is no cancellation, and he/she will be charged the full amount of the appointment if the provider reports the incident to Jaribu. For Event Appointments (Spa Parties, Corporate Massage, etc.) Jaribu requires a 48 hour notice per provider for cancellation. Failure to give this notice will result in being charged the full amount of the appointment. For events that are longer than one day, the cancellation must occur at least 24 hours before the initial date of the ongoing event. MASSAGE PROVIDERS: For our self-serve bookings, massage providers using Jaribu have a 12 hour cancellation policy (per massage provider). If you, as a client, do not receive this notice, you should contact booking@jaribu.id RESCHEDULING, LATENESS, NO SHOW The rescheduling of appointments is between the provider and the client. However, if the client does not give 12 hour’s notice prior to rescheduling, the provider does have the right (if he, she chooses) to charge the client for the full appointment. CLIENTS LATE : Clients have a 15 minute grace period for their massage. If he/she arrives at said location within 15 minutes of the appointment time, there will be no additional charges. Anything beyond 15 minutes will be taken off the time of the massage. VENDOR LATE : There is no lateness grace period for massage facilities. Massage facilities should work this out with the client individually. Mobile massage providers have a 30 minute grace period on their arrival time. If they are late beyond 30 minutes, then client can choose one of the following: Home/Hotel Appointments, etc. A. Client can refuse the massage entirely and return 70% fee from the vendor. B. Client can get client 25% off the massage - getting the full duration of the original appointment. C. Client can get an extra 30 minutes for free (on top of the full duration of the original appointment.) Event Appointments The time for the lateness is usually taken off the final bill, or the therapist can add extra time at the end. This is something to be worked out on an individual basis with the Jaribu staff. CLIENT NO SHOW: If the massage provider shows up at the location, and the client is not there within 15 minutes of the specified time, then the massage will not be performed, and either the massage provider (if self-serve) or the Jaribu staff (if concierge) has the right to charge the client in FULL. VENDOR NO SHOW: If the massage provider(s) does not show up at all (or beyond 1 hour after the appointment time), client does not have to accept the massage. If you, as a client, experience this, you should contact booking@jaribu.id REFUNDS Jaribu does not offer any refunds if the client was unhappy with the quality of the massage, however you can request a refund from the individual provider. Refunds can often be provided for no shows, cancellations or lateness. CLIENT DISPUTES WITH PROVIDERS Appointments booked directly through the Jaribu Websites, any disputes between client and provider have nothing to do with Jaribu. However, client is free to post a negative review of that provider on the Jaribu website if he or she is unhappy with the service provided. Provider can also post a rebuttal to that review. Providers on our network also reserve the right to refuse giving a massage to a client after speaking with them on the phone before the appointment (as long as they do not commit to the appointment). Providers can also refuse giving a massage after meeting the client in person before the massage is to begin. SERVICE MISCONDUCT VENDOR : If reports come back from client that there was provider misconduct, Jaribu has the right at its sole discretion to take provider's profile off the website. CLIENT : If reports come back from provider that there was client misconduct, Jaribu has the right at its sole discretion to immediately suspend that client's membership. Some examples of misconduct include: no shows, extreme lateness, poor massage practices, and unethical behavior. If a provider profile is deleted or a client is dismissed from the website for misconduct, all future billings will be suspended after the end of that current billing cycle. JARIBU ACTS ONLY AS AN INTRODUCER The Services enable those seeking Professional Services to book appointments with Independent professionals seeking to provide such Professional Services. Whilst Jaribu assesses Independent professionals who wish to provide Professional Services, we do not guarantee or warrant, and make no representations regarding the reliability, quality or suitability of Independent professionals. This is entirely a matter for you. Accordingly, you acknowledge and agree that Jaribu does not have any obligation to conduct any background checks on any Independent professional and have no obligation in respect of any service they may provide. When interacting with any Independent professional you should exercise caution and common sense to protect your personal safety, details and property, just as you would when interacting with other persons who are unknown to you. PROMO CODES AND REFERRALS We may from time to time create and offer promotional codes and referral codes (together “Codes”) that can be redeemed against purchases of Professional Services or Products. Codes will only be valid for a period of time stated on or with them. Codes do not have any cash value. Codes may: (1) only be used for personal and non-commercial purposes. You can share your unique code with your personal connections via social media where you are the primary content owner. Codes may not be duplicated, sold, transferred, distributed or made available to others online (including through public sites such as coupon sites) or by other means; (2) not be promoted in any way including via a search engine; (3) not be exchanged for cash; (4) only be used once and only one Code may be used per person; and (5) may be subject to specific terms which will be made available by us, and must only be used in accordance with those terms. In addition, from time to time we may issue referral codes to allow you to refer friends and family to the Services, and which may reduce the Treatment Fee and / or Product Fee (“Referral Codes”). Referral Codes will be limited to 25 referrals per user. If you wish to continue using the Referral Code for more than 25 referrals, please email booking@jaribu.id and we may (but are not obliged to) extend the use of the relevant Referral Code. Discounts cannot be used in conjunction with any other offers or discounts. PROHIBITED USE The Services are for your personal and non-commercial use and must only be used for the purposes of inquiring about or making bookings for Professional Services as expressly described above. You must not use Our Site, or the Services to do any of the following (each of which is strictly prohibited): • Engage in any inappropriate behavior including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behavior; • Restrict or inhibit any other user from using and enjoying the Services; • Infringe the privacy rights, property rights, or other civil rights of any person; • Harass, abuse, threaten or otherwise infringe or violate the rights of Independent professionals, Jaribu (including its employees and personnel) or others; • Harvest, data-mine or otherwise collect information about others, including email addresses, without their consent; • Use technology or other means to access our computer network, unauthorized content or non-public spaces; • Introduce or attempt to introduce any viruses or any other harmful code, files or programs that interrupt or otherwise or limit the Services, or Our Site functionality, or damage, disable or otherwise impair our servers or networks or attempt to do the same; or • Engage in or encourage others to engage in criminal or unlawful conduct or breach Our Terms including misuse of the Services for unlawful or unauthorized purposes. You agree not to breach Our Terms in any way which may result in, among other things, termination or suspension of your access to the Services. INTELLECTUAL PROPERTY JARIBU, the Jaribu logo, brand and all other intellectual property rights, trademarks, service marks, graphics and logos used in connection with the Site, or the Services (whether registered or unregistered) belong to us or our licensors (as are applicable) and are protected by intellectual property law. Nothing in Our Terms grants you any rights in the Site, or Services or the content within the same. All rights are reserved. DISCLAIMER As noted above, we introduce individuals seeking Professional Services to Independent professionals seeking to provide such Professional Services. We are not liable or responsible for the fulfilment of any booking or the performance of the Independent professional. You acknowledge and agree that we are not responsible for addressing any claims you have as regards any Independent professional or any Professional Services, however we do try
